These Terms of Service (the "Terms") contain a BINDING ARBITRATION AGREEMENT and CLASS ACTION WAIVER in Article 19 that affect your legal rights. Please review them carefully. If you are a U.S. resident, you have the right to opt out of arbitration within 30 days of first accepting these Terms as described in Article 19.

By accessing or using Plumic, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Article 1. Purpose and Scope

These Terms of Service govern your access to and use of the "Plumic" service (the "Service") operated by Countdn AI (the "Company," "we," "us," or "our"). These Terms constitute a legally binding agreement between you ("User," "you," or "your") and the Company, and define the rights, obligations, and responsibilities of both parties with respect to the Service.

The Service is offered globally via the web. You are responsible for ensuring that your use of the Service complies with the laws of the jurisdiction in which you access it. Where the mandatory consumer protection or data protection laws of your jurisdiction provide you with rights that cannot be waived by contract, those rights prevail over any conflicting provisions of these Terms to the extent required by such laws.

Article 2. Definitions

For the purposes of these Terms, the following definitions apply:

  1. "Plumic" or "Service" means the AI-powered advertising creative generation platform operated by the Company, including all applications, websites, APIs, features, and related customer support.
  2. "User Content" means any content uploaded, submitted, or provided by you to the Service, including but not limited to product photos, model photos, visual style reference images, text descriptions, and brand materials.
  3. "Generated Output" means any advertising images, advertising copy, text, or other creative materials generated by the Service based on User Content, User prompts, or other User inputs.
  4. "Subscription" means a recurring paid plan that provides access to the Service and a monthly allocation of Credits.
  5. "Credits" means the units of virtual currency used within the Service to generate advertising content. Credits are provided as part of a Subscription or purchased separately.
  6. "Purchase" means any transaction in which you pay for a Subscription, Credits, or other paid features using the payment methods designated by the Company.
  7. "Brand Hub" means the feature that allows you to save frequently used photos and brand materials within the Service.
  8. "Account" means the registered user account through which you access the Service.
  9. "Acceptable Use Policy" or "AUP" means the rules governing permitted and prohibited uses of the Service, as set forth in Article 11 and as the Company may update from time to time.

Any terms not defined herein shall have the meanings ascribed to them under applicable law or common industry usage.
